Legal Guarantee of Conformity

All products purchased from R.G. Sound enjoy the legal guarantee of conformity pursuant to the Consumer Code. The lack of conformity exists when the product is not suitable for the use for which it is to be used normally, is not in accordance with the description or does not possess the qualities promised by the seller, does not offer the qualities and performance usual for a good of the same type, is not suitable for the particular use intended by the consumer if brought to the attention of the seller at the time of purchase and accepted by the seller (art. 129 of the Consumer Code).

Professional Customer
The professional customer has the right to invoke the warranty for defects within 1 (one) year from delivery of the purchased Product (art.1490 et seq. of the Civil Code) and the related defects must be reported within the time limits set out in art. 1495 c.c.

Consumer Customer
The consumer (the natural person who acts for purposes unrelated to entrepreneurial, commercial, artisanal or professional activity that they may carry out) who has purchased a product from our company has the right to a 24-month warranty for defects of conformity, pursuant to the Consumer Code (d.lgs.206/05, articles 128-135). To avail of warranty assistance, the Customer must retain the invoice or tax receipt attached to the order summary that they will receive in paper form together with the goods. The customer, by accepting the purchase contract, acknowledges receipt of the assistance methods in place at the time of purchase.

The 24-month warranty (pursuant to D.Lgs. no. 206 of 06/09/2005 of the Consumer Code) applies to the product that presents a defect of conformity, provided that the product is used correctly, in compliance with its intended use and as provided in the attached technical documentation. This warranty is reserved for the Private Consumer (natural person who purchases goods for purposes not related to their professional activity, or who makes the purchase without indicating a VAT number reference in the order form).

In case of non-conformity, R.G. Sound proceeds to restore the conformity of the product through repair/replacement or reduction of the price, up to termination of the contract. Only following the release of an RMA authorization number (assistance code assigned), obtainable by accessing your personal profile and clicking on "Assistance", the customer must send the product following the instructions contained in the email that R.G. Sound will send once the "fault" is reported.

In the event that, for any reason, R.G. Sound is unable to return to its customer a product under warranty (restored or replaced), R.G. Sound may at its discretion proceed to refund the entire amount paid or replace it with a product with characteristics equal to or better. If, following intervention by an Authorized Service Center, the defect does not prove to be a lack of conformity pursuant to DL 24/02, the Customer will be charged for any verification and restoration costs required by the Authorized Service, as well as transport costs if incurred by R.G. Sound.

R.G. Sound is not responsible for damage to things or persons resulting from malfunctions or incorrect installation of the products. Since it is electronic material, proper skills and experience are necessary to proceed with safe installation; consequently, products damaged by lack of skill or carelessness are excluded from warranty coverage.

Regarding accumulators (batteries), the warranty is not applicable in the following cases:

  • when the battery is discharged due to non-use, current draw from the electrical system, oxidized or poorly connected terminals;
  • if the malfunction is due to improper use, unadvisable or incorrect applications, carelessness in use, tampering, incorrect installation or incorrect maintenance (lack of charging or charging with inappropriate voltage/current), negligence, or circumstances that, in any case, cannot be attributed to defects in the functioning of the product itself.
  • R.G. Sound reserves the right not to consider a product under warranty if the product output number has been erased, tampered with or even partially covered (for example, for Optima batteries, the barcode label and the hot-stamped initials on the battery body)

Manufacturer's Warranty

All products are covered by both the Legal Warranty and the Manufacturer's Warranty. The manufacturer's conventional warranty is provided according to the methods illustrated in the documentation present inside the product packaging. The Manufacturer's Warranty is added to, but does not replace, the 24-month Legal Warranty in any case due to the consumer by law, under the conditions provided by law. Should you decide to avail yourself of the Manufacturer's Warranty, the consumer can identify below the nearest authorized Technical Service Center. If, following intervention by an Authorized Service Center, the defect proves to be not covered by the manufacturer's conventional warranty, the Customer will be charged for any verification and restoration costs required by the authorized Service, as well as transport costs, if incurred by R.G. Sound.

In case of a used product or with packaging deteriorated for any reason, the depreciation suffered will be calculated and the difference on the cost of the product itself will be refunded.

The Consumer Customer who does not comply with the withdrawal procedures described above may obtain again, at their own expense, the Product in the condition in which it was returned to R.G. Sound. Otherwise, R.G. Sound may retain the returned products, in addition to all amounts already paid by the Consumer Customer for the relative purchase. Shipping and transport costs are borne by the Customer.

R.G. Sound will refund the price of the product paid by the Customer, 14 days from receipt of the product complete with all its parts and perfectly functional.

Within 14 days from receipt of the goods, the customer must communicate the decision to exercise the right of withdrawal by registered mail with return receipt, email or fax to the address above and indicating the refund method: bank account (indicate IBAN and account holder name), or PayPal (if used) and the details of the chosen method.
  2. Upon receipt of this communication, R.G. Sound authorizes the return of the goods by sending an email to the customer's address.
  3. The customer prepares the product to be returned, carefully packaging it in the original packaging and inserting all accessories and contents originally included. The product and accessories must not show any signs of use. The customer must ship within 14 days following receipt of the authorization email for return of the goods.

In case of withdrawal on an order with free shipping, euro 7.50 will still be retained as partial coverage of the initial transport.
